QUESTION: With the early 2024 primary elections for President and State/local representatives and the November 2024 General Election that includes the election of the President, Congressional Representatives, and many State and local officials, can I erect a sign in my yard that expresses my preference for a candidate, an issue, or a political party?

ANSWER: Yes, as long as the sign complies with Article XI, Signs, of the Springs CCR's:

. . .Political signs may be erected upon a Lot by the Owner of such Lot advocating the election of one or more candidates or the sponsorship of a political party, issue, or proposal provided that such signs shall not be erected more than 90 days in advance of the election to which they pertain and are removed within 10 days after the election.  The HOA may remove a sign displayed in violation of a restrictive covenant permitted by this Article.

Bold text denotes statutory requirements included in the amendment to Section 259.002 of the Texas Property Code by the Texas State Legislature in 2019.  The State amendment was approved and effective September 1, 2019.

 

These Discussion area messages intend to remind residents of The Springs of the Covenants, Conditions, and Restrictions (CCR’s) that apply to all Springs residents solely by our election to live in this community. The purpose of the CCR’s is to maintain specific standards for the good of us all, as articulated in their definition:

“THE SPRINGS AT STONE OAK is encumbered by these Restrictive Covenants for the following reasons: to seek to achieve the best and highest use and most appropriate development of the property; to protect lot owners against improper use of surrounding lots; to preserve so far as practical the natural beauty of the property; to guard against the erection of poorly designed or proportioned structures of improper or unsuitable materials; to encourage and secure the erection of attractive improvements on each lot with appropriate locations; and to secure and maintain proper setbacks from streets and adequate free space.”
